Entry into force of the Law on Amendment and Supplementation of the Public Procurement Act (published in SG, issue 86 of 18.10.2018)

In issue 86 of the State Gazette of October 18, 2018, the Law on Amendment and Supplementation of the Public Procurement Act (ZIDZOP) was published. The law enters into force on March 1, 2019, except for some changes, for which different deadlines are provided, depending on the issues they regulate. Provisions which enter into force on dates other than 1 March 2019 shall be as follows:

From the day of publication of the law in the State Gazette (from 18th of  October  2018) the amendments to Art. 201, para. 2; Art. 204, para. 5; Art. 205, para. 7; Art. 213, para. 2; Art. 216a of the Public Procurement Act and § 138 of the Public Procurement Act. They relate to the appeal proceedings against orders and orders of the Competition Commission before the Supreme Administrative Court.

From 18 October 2018, the transitional paragraphs in the PPA, which introduce the mandatory use of the electronic procurement platform, are repealed. The implementation of the platform will be done in two stages. It will be fully completed with full functionality by the end of 2020.

From 1 November 2019, the provisions introducing the mandatory application of the national electronic platform from the opening of procedures till to the receipt and opening of electronic applications and tenders, as well as electronic communication in the course of the procurement, shall enter into force. Up to this date, training, testing and registration of users of the platform is planned to be carried out with a view to unobstructed and smooth transition to e-procurement.

From 1 January 2021, the rules governing the implementation of all platform functionality will also apply.
