Public Procurement Agency publishes Practical Handbook for Green Public Procurement

The tool raises awareness of the benefits of green public procurement and assists contracting entities and businesses in using environmental criteria in the procurement process. It contains specific examples of the use of environmentally friendly requirements, which are integrated in the selection criteria, in the technical specifications, as indicators in the complex evaluation of tenders, as well as in the clauses of the draft contract.

The practical tool was developed by PricewaterhouseCoopers Bulgaria EOOD under a public procurement contract of May 15, 2018 with the subject: “Study and forecasting of the potential of the national market for green public procurement in Bulgaria and preparation of a practical tool for their awarding” , part of the project “Methodological Support for the Development of Green Public Procurement in Bulgaria”, funded under Priority Axis 3 “Private Sector” of the Bulgarian-Swiss Cooperation Program (BCSP).

Training for work with the Centralized Automated Electronic Public Procurement Information System has started

Pursuant to a contract for the development, implementation and maintenance of a single national electronic web-based platform: Centralized Automated Electronic Procurement Information System (CAIS EOP) The Procurement Agency will deliver 11 trainings for over 1,100 end users to work with the system.

The trainings are free of charge and the lecturers are representatives of the system developer – Consortium “EOP Bulgaria”. Their purpose is to start acquainting and educating the various stakeholder groups in the procurement process. These include representatives of contracting authorities, economic operators, control bodies in the field and the media.

The first three trainings took place in the period January 28-30, 2019 and were successfully and with great interest. They were trained by over 300 representatives of the largest contracting authorities in the country.…

A draft Council of Ministers Decree was published on the Public Consultation Portal proposing the adoption of an Ordinance on External Experts in the Preliminary Control of Public Procurement and amending the Rules for the Implementation of the Public Procurement Law and the Rules of Organization of the Public Procurement Agency orders.

The proposed changes are related to the amendments to the Law on Public Procurement, promulgated in the State Gazette, issue no. 86 of 18.10.2018. The main part of them relate to the creation of a normative basis for the gradual transition to a fully electronic procurement in the country.

Public Procurement Agency with project under OP “Good Governance 2014-2020

The Public Procurement Agency made a public presentation of the project “Review and Evaluation of the Public Procurement System in Bulgaria”, which it has been working on for several months. It is implemented with the financial support of the Operational Program Good Governance. As a result of the project, it is expected that an up-to-date evaluation of the national public procurement system will be made after a comprehensive review is carried out.

The press conference was attended by Project Manager Miglena Pavlova, Executive Director of the Public Procurement Agency, and Knut Leipold, Chief Procurement Specialist at the International Bank for Reconstruction and Development and head of a team of independent external consultants who will evaluate the work performed.

Entry into force of the Law on Amendment and Supplementation of the Public Procurement Act (published in SG, issue 86 of 18.10.2018)

In issue 86 of the State Gazette of October 18, 2018, the Law on Amendment and Supplementation of the Public Procurement Act (ZIDZOP) was published. The law enters into force on March 1, 2019, except for some changes, for which different deadlines are provided, depending on the issues they regulate. Provisions which enter into force on dates other than 1 March 2019 shall be as follows:

From the day of publication of the law in the State Gazette (from 18th of  October  2018) the amendments to Art. 201, para. 2; Art. 204, para. 5; Art. 205, para. 7; Art. 213, para. 2; Art. 216a of the Public Procurement Act and § 138 of the Public Procurement Act. They relate to the appeal proceedings against orders and orders of the Competition Commission before the Supreme Administrative Court.

From 18 October 2018, the transitional paragraphs in the PPA, which introduce the mandatory use of the electronic procurement platform, are repealed. The implementation of the platform will be done in two stages. It will be fully completed with full functionality by the end of 2020.

Today the National Assembly adopted the Law on Amendments to the Public Procurement Act. Forthcoming presidential decree is to be issued and its publication in the State Gazette

With the adoption of the law, public procurement enters a qualitatively new stage through the use of electronic means and the central electronic platform created for this purpose. The rules for their gradual introduction are regulated in detail in the law. Mandatory use of the platform will take effect from November 1, 2019. This will allow for a smooth transition to the new way of contracting, including step-by-step registration of all users (contracting entities, economic operators, control bodies) and conducting trainings for working with the platform.

Provisions related to the entire award process have been specified. The procedure for signing, serving and receiving electronic documents in the course of the procedures is regulated.

The law introduces the requirements of Directive 2014/55/EU on e-invoicing for public procurement. The obligation of the contracting authorities to accept and process electronic invoices for payment under public procurement contracts is regulated. E-invoices should be compatible with the European standard for electronic invoicing.
